We do not provide legal advice, legal opinions, legal representation or attorney referral services, and no attorney-client relationship is created by using this website, submitting a form or purchasing a service. Communications with us are not protected by attorney-client privilege.
What we do is prepare, classify and submit filings using the information you give us, and track those filings. Where your situation calls for legal advice — assessing infringement, responding to a demand letter, an opposition or cancellation proceeding before the Trademark Trial and Appeal Board, or any litigation — you should retain a licensed attorney, and we will tell you when we think that point has been reached.
No government affiliation
Defend Your Trademark LLC is an independent private company. We are not affiliated with, endorsed by, sponsored by or associated with the United States Patent and Trademark Office, the United States Copyright Office, or any other government agency or department. Official information is available directly from uspto.gov and copyright.gov, and you may file with either office yourself without using our service.
No guaranteed outcome
Whether an application is approved is decided by a government examining attorney applying their own judgement. We cannot and do not guarantee that any application will be accepted, published or registered, or that a search will surface every conflicting mark, or that a takedown notice will result in removal. Past results do not indicate future outcomes.
Government fees are separate
All prices shown on this site are for our services only. Government filing fees are set by the USPTO and the US Copyright Office, are charged per class or per work, are paid to those offices, and are non-refundable once a filing is submitted regardless of the result. Government fees are subject to change without notice.
Information is general
Articles, guides, timelines and FAQs on this site are general information about US trademark and copyright procedure. They are not advice about your circumstances, they may become out of date as law and USPTO practice change, and they should not be relied on as a substitute for advice from a qualified attorney.

Filings are public
Trademark and copyright applications become public records. Owner names, addresses, marks, descriptions and specimens are published in searchable government databases and cannot be redacted or withdrawn from the record afterwards.
