A federal registration is not permanent. It has to be maintained on a fixed schedule, and the USPTO does not send a reminder you can rely on. Miss a window and the registration is cancelled — not suspended, cancelled — and you start again from zero with a new filing date and whatever conflicts have appeared in the meantime.

What is included

Section 8 declaration

Due between the fifth and sixth year after registration. Declares continued use and requires a current specimen for each class.

Section 15 incontestability

Optional but valuable. After five years of continuous use it sharply limits the grounds on which anyone can challenge your mark.

Section 9 renewal

Due at the tenth year and every ten years after, filed together with a Section 8 declaration.

Specimen preparation

Frequently asked

There is a six-month grace period with an additional government fee. After that the registration is cancelled and cannot be revived. You would have to file a fresh application and lose your original priority date.
