CLEARANCE · FULL

A free search box tells you whether someone registered your exact name. It does not tell you whether a phonetically similar mark, a translated equivalent, or a design mark with the same commercial impression will stop your application. Those are the refusals that actually happen.

A comprehensive search is the cheapest decision point in the whole process. Running one costs a fraction of a filing fee, and a rebrand before launch costs a fraction of a rebrand after you have printed packaging.

What is included

Federal register

Live and dead marks, pending applications, identical and similar wording, phonetic equivalents, and design marks with a comparable commercial impression.

State registers

State-level registrations that will not appear in a federal search but can still support a claim against you in that state.

Common-law use

Unregistered marks in active commercial use — business directories, domains, marketplace listings and trade sources — since prior use can beat a later registration.

Class and goods analysis

Whether a similar mark actually collides with you depends on relatedness of goods and channels of trade. We assess that, not just name similarity.

Written risk report

A plain-English report grading each conflict as high, moderate or low, with the reasoning, so you can make a business decision rather than read a raw data dump.

Alternatives review

If the name is a problem, send us your shortlist. We will tell you which of your backups look clean before you fall in love with another one.

How it works

  1. 01

Send us the mark and the goods

The exact name or logo and a description of what you sell. The goods matter as much as the name.

  2. 02

    We run the search

Federal, state and common-law sources, including phonetic and near-miss variants and translated equivalents.

  3. 03

    We grade the conflicts

Each result is assessed for likelihood of confusion, not just similarity, and graded by severity.

  4. 04

    You get the report

Delivered as a written PDF with a clear recommendation: proceed, proceed with amended goods, or change the mark.

Frequently asked

A free search is a useful first filter and we run one at the start of every filing. It is not clearance. It looks for the same string of letters, and refusals are usually issued over marks that are similar rather than identical.

Next step

Find out whether your name can be registered

Send us the mark and what you sell. Defend Your Trademark runs the preliminary search and comes back with a straight answer — including when the answer is that you should pick a different name.
